Immigrant Visas

General Information

An immigrant visa is required of anyone who wishes to enter the United States to reside there permanently, whether or not that person plans to seek employment in the United States. U.S. immigration law provides for the issuance of immigrant visas in four general categories: immediate relatives, family based, employment based and Diversity Immigrant Visa Program (also known as the “green card lottery”). In most cases you cannot petition for your own Immigrant Visa. Someone must file a petition on your behalf.

Acceptance of  I-130 Petitions at Asuncion, Paraguay

Effective March 20, 2007 consular post abroad are authorized to accept petitions for immediate relative immigrant classification form American Citizens who are resident in their consular districts including member of the armed forces as well as true emergency cases such as life and death or health and safety and others determined to be in the national interest.

Note: To demonstrate residency in a consular district the American Citizen petitioners must be able to show that they have permission to reside in the consular district and that they have been doing so continuously for at least six months before filing the petition. Individuals who are in the country on a temporary status such as student or tourist would NOT be considered to meet the residency standard.

All lawful permanent residents and American Citizens resident in the United States or with a permanent address in the United States will fife I-130 petitions at the USCIS Service Center having jurisdiction over their place of residence.
